A MAP policy sets the lowest price a retailer may advertise your product at. It governs advertising, not the sale — and that distinction is the whole reason MAP is workable where dictating resale price is not.

MAP is not minimum resale price

Telling a retailer what they may ADVERTISE is treated very differently from telling them what they may SELL for. Policies that blur the two invite exactly the legal problem MAP is structured to avoid, and using the terms interchangeably in your own document is how that happens.

A policy is not an agreement

MAP is commonly implemented as a unilateral policy the brand announces and enforces by choosing who to supply — not as a term negotiated with each retailer. That structure is deliberate and it is worth preserving in how the document is written.

Unenforced is worse than absent

A policy applied to some retailers and not others is evidence against you and destroys the trust of the retailers who complied. Consistency matters more than severity.

What the protocol tracks
